App terms

First aid helps. A vet still matters.

The app provides general first-aid guidance while you seek professional veterinary care. These terms explain its intended use and limits.

The important bit

Vet in a Van Pet First Aid is a first-aid reference, not a substitute for professional veterinary care. It's designed to help you act sensibly in the first minutes of an emergency and to know when, and how urgently, to seek a vet. In a serious or life-threatening situation, contact your veterinarian or nearest emergency animal hospital immediately.

1. About these terms

These App Terms of Use apply when you download, install, access or use Vet in a Van First Aid.

The App is published by Vet in a Van Pty Ltd, ABN 71 639 098 212.

The App is currently available on Android, with iOS on the way.

In these terms:

  • App means Vet in a Van Pet First Aid and its included first-aid content, updates and related services
  • App Content means the first-aid information, triage labels, symptoms, action steps, prevention information, warnings, images and other material in the App
  • Vet in a Van, we, us and our mean Vet in a Van Pty Ltd
  • you and your mean the person who downloads, installs, accesses or uses the App

By selecting I understand and agree, or by continuing to use the App after being presented with these terms, you agree to them.

If you do not agree, do not use the App and uninstall it.

Our Privacy Policy explains how information is handled. Use of mypetfirstaid.com.au is subject to the separate Website Terms of Use.

2. The App's purpose

Vet in a Van Pet First Aid is a general first-aid reference for Australian dog and cat owners.

It is designed to provide:

  • recognisable symptoms
  • general first-aid actions
  • prevention information
  • an indication of urgency
  • guidance about when to seek veterinary care
  • relevant do-not-do warnings and Australian notes where included

The App is designed to help a user act sensibly while professional veterinary care is being arranged or obtained.

It is not designed to replace a veterinarian.

3. Important veterinary warning

The App and App Content:

  • do not provide a veterinary consultation
  • do not provide a confirmed diagnosis
  • do not prescribe treatment or medicine
  • are not tailored to an individual animal
  • do not establish a veterinarian-owner-animal relationship
  • do not mean that Dr Tania Mitchell or another veterinarian has examined, accepted or taken responsibility for an individual animal
  • do not monitor an animal's condition
  • cannot confirm whether an animal is safe to remain at home or safe to travel

In a serious or life-threatening situation, contact your veterinarian or nearest emergency animal hospital immediately.

Do not delay veterinary care while using or searching the App.

4. Emergency use and triage

Triage labels in the App are general guides based on the topic selected. They are not a diagnosis and cannot account for every animal or circumstance.

An animal may require more urgent care than the selected topic suggests.

Seek immediate veterinary help where:

  • the animal is unconscious, collapsing or having difficulty breathing
  • there is severe bleeding
  • a toxin, poison, bait or unknown substance may have been swallowed
  • a snake bite, tick paralysis or envenomation is suspected
  • the animal is having repeated seizures
  • the animal is in severe pain or distress
  • the animal's condition is worsening
  • you are uncertain whether the situation is an emergency

The examples above are not exhaustive.

If you cannot contact your usual veterinarian, contact the nearest available veterinary clinic or emergency animal hospital.

5. Your responsibility when using first-aid guidance

First aid involves judgement and can involve risk.

You are responsible for:

  • deciding whether it is safe to approach or handle an animal
  • protecting yourself and others from bites, scratches, traffic, toxins and environmental hazards
  • selecting the correct species and topic
  • considering whether the App Content matches the situation
  • following warnings and instructions carefully
  • stopping an action if the situation becomes unsafe
  • obtaining veterinary advice and treatment without unreasonable delay
  • arranging safe transport
  • telling the treating veterinarian what occurred and what first aid was attempted

Do not perform an action beyond your skills or physical ability.

Do not put yourself, another person or the animal in further danger.

If App Content conflicts with advice from a veterinarian who knows the animal or has assessed the situation, follow the veterinarian's advice.

6. Limits of general information

Animals with similar symptoms may have different conditions. A condition can also change rapidly.

The App cannot take account of all relevant factors, including:

  • full medical history
  • current medicines
  • allergies
  • breed
  • age
  • weight
  • pregnancy
  • underlying illness
  • previous treatment
  • the amount or type of toxin involved
  • the time since an incident
  • environmental conditions
  • travel time to veterinary care

The App may not contain every condition, hazard, medicine, poison, plant, toxin or first-aid technique.

Absence of a symptom or topic does not mean that an animal is safe.

7. Medicines, substances and procedures

The App does not authorise you to:

  • give a prescription medicine
  • alter a veterinarian's prescribed dose
  • use a human medicine on an animal
  • induce vomiting unless the App expressly directs you to obtain professional advice and a veterinarian or recognised poison service tells you to do so
  • use a product contrary to its label
  • perform surgery or an invasive veterinary procedure
  • continue an action that causes distress or creates danger

Use medicines, antiseptics, chemicals and other products only:

  • for the species stated on the label
  • in accordance with the label
  • before expiry where an expiry applies
  • as directed by a registered veterinarian where veterinary direction is required

The inclusion or mention of a product, item or technique does not mean it is appropriate for every animal or situation.

8. Species and intended users

The App Content is written for dogs and cats.

Do not use dog content for a cat, cat content for a dog, or App Content for:

  • humans
  • livestock
  • horses
  • birds
  • reptiles
  • wildlife
  • another species

unless a registered veterinarian specifically directs you to do so.

If you are under 18, use the App with the involvement of a parent or guardian where reasonably possible.

9. Offline use and content updates

The App works offline for normal first-aid use. No internet connection is required to use it, and first-aid content is stored on your device.

When you are online, the App may check for and download revised first-aid content.

If you are offline:

  • the App can continue using the content already stored on your device
  • an available update may not yet have been downloaded
  • the content on your device may not be the most recently published version

You are responsible for installing App updates and allowing content updates where reasonably practicable.

We do not promise that an update will reach every device immediately or that an older device will support every future release.

10. App availability and technical limitations

We take reasonable steps to provide a stable and usable App, but we do not guarantee that it will:

  • work on every device
  • work with every operating-system version
  • always be available
  • be free from all defects
  • remain compatible with future device or store changes
  • display correctly where a device has been modified
  • remain available in every country or app store

A low battery, damaged device, storage limitation, operating-system setting or other technical issue may prevent access.

Do not rely on the App as your only emergency preparation. Before travel, identify veterinary services along your route and carry appropriate contact details and first-aid supplies.

11. Licence to use the App

Subject to these terms, we grant you a limited, revocable, non-exclusive, non-transferable licence to install and use the App for personal, non-commercial purposes on devices that you own or control, subject to applicable app-store rules.

The App is licensed, not sold.

You must not, except to the extent permitted by law:

  • copy, distribute, sell, rent, lease or sublicense the App
  • reverse engineer, decompile, disassemble or attempt to derive source code
  • modify or create a derivative work from the App or App Content
  • remove intellectual-property notices
  • extract or republish substantial App Content
  • use App Content to train, fine-tune or evaluate a commercial artificial-intelligence system
  • use the App to provide veterinary services or advice to another person
  • use automated systems to scrape or harvest content
  • bypass security or technical restrictions
  • create or distribute an unofficial or modified version

Open-source components, if any, remain subject to their own licence terms.

12. Intellectual property

We own or license the App, App Content, branding, design, text, graphics, illustrations and software, except where otherwise stated.

No ownership rights are transferred to you.

You may make ordinary personal use of information displayed in the App. You must not present App Content as your own professional advice or imply that Vet in a Van endorses your service, product or organisation.

Nothing in these terms limits a right you have under the Copyright Act 1968 or another law that cannot lawfully be restricted.

13. Privacy

The App has no account, no advertising and no behavioural tracking.

Our Privacy Policy explains:

  • information stored locally on the device
  • limited technical processing associated with content updates
  • how the website launch list operates
  • service providers
  • retention, deletion and privacy enquiries

The Privacy Policy should be read with these terms.

14. Third-party services

The App is distributed through third-party app stores and operates on third-party devices and operating systems.

You must comply with applicable terms imposed by:

  • Google Play
  • Apple
  • your device manufacturer
  • your network or internet provider

We are not responsible for an app store, device manufacturer or network provider's independent acts, omissions, terms or service availability.

15. Support

You may contact us about App access, content or technical issues using the contact details below.

Support is not:

  • a veterinary consultation
  • an emergency veterinary service
  • a substitute for contacting a veterinary clinic
  • guaranteed to be available at a particular time

Do not send urgent animal-health requests to the support email.

16. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.

Where a guarantee, condition or warranty is implied by law and liability can lawfully be limited, our liability is limited, at our option and to the extent permitted by law, to:

  • supplying the relevant service again
  • paying the reasonable cost of having the relevant service supplied again

This clause does not apply where such a limitation would be unfair, unreasonable or unlawful.

17. Responsibility and limitation of liability

First aid cannot guarantee recovery or prevent deterioration, injury or death.

To the maximum extent permitted by law, we are not responsible for loss, damage, cost or liability caused by:

  • using the App as a substitute for veterinary care
  • delaying contact with or travel to a veterinarian
  • selecting the wrong species, topic or information
  • misunderstanding or incorrectly performing an action
  • failing to follow a warning, label or veterinary instruction
  • using an item, medicine or substance inappropriately
  • continuing an action after it becomes unsafe
  • an animal's underlying condition or unpredictable response
  • incomplete or inaccurate observations by the user
  • use of an outdated App version, screenshot, copy or reproduction
  • failure to install an available update
  • loss of device access, battery, storage, connectivity or compatibility
  • third-party systems or events outside our reasonable control

To the maximum extent permitted by law, we exclude liability for indirect, incidental or consequential loss that was not reasonably foreseeable when the App was used.

We do not exclude liability to the extent that loss is directly caused by our fraud, wilful misconduct, breach of a non-excludable statutory guarantee or other liability that cannot lawfully be excluded.

Nothing in these terms makes you responsible for loss caused by us or excuses us from taking reasonable care where the law requires us to do so.

18. No guarantee of outcome

Statements about first aid, stabilisation, urgency or avoiding common mistakes describe the intended purpose of the guidance. They are not promises that:

  • a condition will be correctly identified
  • an animal will stabilise
  • deterioration will be prevented
  • veterinary treatment will succeed
  • injury, illness, expense or death will be avoided
  • a particular action will be safe in every circumstance

The outcome depends on matters that may be unknown and outside the control of both the user and Vet in a Van.

19. Changes, suspension and discontinuation

We may update, suspend or discontinue the App or part of it where reasonably required to:

  • improve safety or accuracy
  • correct content
  • address a security issue
  • comply with law or app-store requirements
  • support a new operating system
  • retire an unsupported feature or version

We will not use this clause to retrospectively remove rights or remedies that have already arisen.

Where a material change to these terms requires renewed acceptance, the App may ask you to review and accept the updated terms before continuing.

20. Ending your use

You may stop using the App at any time by uninstalling it.

We may restrict access to an online component where reasonably necessary because of unlawful misuse, security risk or a material breach of these terms.

Any provision intended by its nature to continue after use ends will continue, including provisions about intellectual property, liability, governing law and accrued rights.

21. App-store specific terms

Google Play

Where you obtain the App through Google Play:

  • Google is not a party to these terms
  • Google does not provide veterinary advice through the App
  • your use is also subject to applicable Google Play terms
  • questions and claims about the App should be directed to Vet in a Van unless Google is responsible under its own terms or applicable law

Apple App Store

This section applies only if and when the App is distributed through the Apple App Store.

You and Vet in a Van acknowledge that:

  1. these terms are between you and Vet in a Van, not Apple
  2. Vet in a Van, not Apple, is responsible for the App and App Content
  3. your licence is a non-transferable licence to use the App on Apple-branded products that you own or control, as permitted by Apple's usage rules, including permitted Family Sharing, volume purchasing or Legacy Contact use
  4. Vet in a Van is responsible for maintenance and support required under these terms or applicable law, and Apple has no obligation to provide maintenance or support
  5. Vet in a Van is responsible for warranties that apply by law and for claims relating to the App, including product-liability, regulatory and consumer-protection claims
  6. if the App fails to conform to an applicable warranty, you may notify Apple and Apple may refund any purchase price paid for the App, after which Apple has no further warranty obligation to the maximum extent permitted by law
  7. Vet in a Van, not Apple, is responsible for investigating and addressing third-party intellectual-property claims relating to the App
  8. you must comply with applicable third-party terms when using the App
  9. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce the Apple-specific provisions against you after acceptance
  10. you represent that you are not located in a country or region subject to a United States Government embargo or designated as supporting terrorism, and you are not listed on a United States Government prohibited or restricted-party list

22. Changes to these terms

We may update these terms when the App, law, veterinary guidance, service providers or app-store requirements change.

The current version and effective date will be published at mypetfirstaid.com.au/app-terms.

Changes apply from the stated effective date. They do not retrospectively remove rights or remedies that arose before the change.

23. Severability

If a provision of these terms is invalid or unenforceable, it is to be read down to the minimum extent necessary. If it cannot be read down, it is severed.

The remaining provisions continue to apply.

24. Governing law

These terms are governed by the laws of Victoria, Australia.

You and we submit to the non-exclusive jurisdiction of the courts of Victoria and courts entitled to hear appeals from them.

This clause does not prevent you from relying on a right to bring a claim in another jurisdiction where that right cannot lawfully be excluded.
