These terms explain how you may use mypetfirstaid.com.au and the general pet first-aid information on it.

1. About these terms

These Website Terms of Use apply when you access or use mypetfirstaid.com.au, including its text, images, downloads, links and other content.

The website is operated by Vet in a Van Pty Ltd, ABN 71 639 098 212.

In these terms:

  • Vet in a Van, we, us and our mean Vet in a Van Pty Ltd
  • Website means mypetfirstaid.com.au
  • Website Content means information, text, graphics, images, downloads and other material made available through the Website
  • App means the Vet in a Van Pet First Aid application
  • you and your mean a person who accesses or uses the Website

By using the Website, you agree to these terms. If you do not agree, do not continue to use the Website.

The App is also subject to the separate App Terms of Use. Our handling of personal information is explained in our Privacy Policy.

2. What the Website provides

The Website provides general information about:

  • Vet in a Van Pet First Aid
  • pet first aid
  • the features and availability of the App
  • how to join the App launch-notification list
  • Vet in a Van and Dr Tania Mitchell
  • related Vet in a Van resources and products

The Website does not provide an online veterinary consultation, diagnosis, prescription, treatment plan or emergency veterinary service.

3. Important veterinary disclaimer

Vet in a Van Pet First Aid and the Website Content are general first-aid references. They are not substitutes for professional veterinary care.

The Website Content:

  • is not tailored to an individual animal
  • does not take account of every symptom, condition or emergency
  • may not account for an animal's complete history, age, breed, weight, pregnancy status, medications, allergies or other relevant circumstances
  • cannot confirm a diagnosis
  • cannot determine whether an animal is stable or safe to travel
  • cannot replace a physical examination by a registered veterinarian
  • does not establish a veterinarian-owner-animal relationship

In a serious or life-threatening situation, contact your veterinarian or nearest emergency animal hospital immediately.

Do not delay seeking veterinary care because of information on the Website.

4. First aid involves judgement and risk

First aid is intended to support an animal while professional veterinary care is being arranged or obtained. It cannot guarantee a particular outcome.

Conditions that appear similar may have different causes and may require different treatment. An animal's condition can also deteriorate quickly.

You remain responsible for:

  • assessing whether it is safe to approach and handle an animal
  • protecting yourself and other people from bites, scratches, traffic, toxins and environmental hazards
  • choosing whether to perform a first-aid action
  • following product labels and veterinary instructions
  • obtaining veterinary care without unreasonable delay
  • arranging safe transport
  • stopping an action if the animal becomes distressed or the situation becomes unsafe

If Website Content conflicts with instructions from a veterinarian who knows the animal or has assessed the situation, follow the veterinarian's instructions.

Do not use Website Content to diagnose or treat a human. Do not use information written for dogs or cats on another species unless a veterinarian specifically directs you to do so.

5. Medicines, poisons and physical products

Website Content does not authorise you to:

  • administer a prescription medicine
  • alter a prescribed dose
  • use a human medicine on an animal
  • induce vomiting
  • use a chemical, antiseptic or treatment contrary to its label
  • perform a veterinary procedure that should be carried out by a registered veterinarian

Only use medicines or regulated products as directed by a veterinarian and in accordance with the product label and applicable law.

The Website may link to a physical Vet in a Van pet first-aid kit or to dogfirstaidkit.com.au. A purchase from another website is governed by the terms displayed on that website.

These Website Terms do not replace:

  • product labels
  • manufacturer instructions
  • safety data
  • expiry information
  • instructions supplied with a physical product
  • advice from a registered veterinarian

If general first-aid information is supplied with a physical kit, it remains general information. The presence of an item in a kit does not mean it is appropriate for every animal, injury or circumstance.

6. Accuracy and currency

We take reasonable care in preparing Website Content. Veterinary knowledge, product information, laws and professional standards can change.

We do not promise that every item of Website Content:

  • covers every possible circumstance
  • is free from minor errors
  • will always be available
  • is the latest information available in every jurisdiction
  • will be suitable for your animal or situation

Content counts, platform availability, app features and store links may change over time. Claims about the App apply only to the version and platform identified when the claim is made.

We may correct, update, remove or replace Website Content when reasonably required.

7. App information and downloads

The Website may provide information about downloading the App from an official app store.

Only obtain the App through an official store link published by us. We are not responsible for unofficial, modified or counterfeit copies of the App.

Your use of:

  • Google Play is also subject to Google's terms
  • the Apple App Store is also subject to Apple's terms
  • the App is subject to the App Terms of Use

A store, device manufacturer or network provider may impose its own requirements and may change availability independently of us.

8. Launch-notification form

You may choose to provide an email address so we can send you the requested App launch notification.

The form is voluntary. Do not submit another person's email address without their permission.

The form is not:

  • a veterinary contact service
  • an emergency communication channel
  • an App account
  • a subscription to general marketing unless you separately consent

Our handling of the email address is explained in our Privacy Policy.

9. Intellectual property

Unless otherwise stated, we own or license the Website, Website Content, branding, graphics, photographs, illustrations, software and other intellectual property made available through it.

We grant you a limited, revocable, non-exclusive and non-transferable permission to access and use the Website for personal, non-commercial purposes.

You must not, without our prior written permission:

  • copy or reproduce substantial Website Content
  • republish Website Content on another website, app or platform
  • sell, license or commercially exploit Website Content
  • remove copyright, trade mark or attribution notices
  • use our branding in a way that suggests endorsement, partnership or approval
  • train, fine-tune or evaluate a commercial artificial-intelligence system using Website Content
  • scrape, harvest or systematically extract Website Content
  • modify Website Content and present it as ours
  • use Website Content to provide veterinary services or advice to another person

You may share an ordinary link to a public page on the Website, provided you do not misrepresent the page or our relationship with you.

Nothing in these terms limits a right you have under the Copyright Act 1968 or another law that cannot lawfully be restricted.

10. Acceptable use

You must not:

  • use the Website unlawfully
  • attempt to gain unauthorised access to the Website or its systems
  • interfere with the security, integrity or availability of the Website
  • introduce malicious code
  • use automated systems in a way that creates unreasonable load
  • impersonate Vet in a Van, Dr Tania Mitchell or another person
  • submit false, misleading or malicious information
  • use the Website to harm an animal or encourage unsafe treatment
  • use our contact details to send spam or abusive communications

We may restrict access where reasonably necessary to protect the Website, users, animals or our legal rights.

11. Third-party websites and services

The Website may link to app stores, veterinary resources, social-media platforms, physical products and other external services.

A link does not mean that we control, endorse or accept responsibility for every statement, product, security practice or service on the external site.

Before relying on or purchasing through an external service, review its own terms, privacy policy, product information and professional credentials.

12. Australian Consumer Law

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including under the Australian Consumer Law.

Where a guarantee, condition or warranty is implied by law and liability can lawfully be limited, our liability is limited, at our option and to the extent permitted by law, to:

  • supplying the relevant service again
  • paying the reasonable cost of having the relevant service supplied again

This clause does not apply where such a limitation would be unfair, unreasonable or unlawful.

13. Responsibility and limitation of liability

The Website and Website Content are provided for general informational purposes.

To the maximum extent permitted by law, we are not responsible for loss, damage, cost or liability caused by:

  • using Website Content as a substitute for veterinary care
  • delaying contact with or travel to a veterinarian
  • selecting information for the wrong species, condition or situation
  • failing to follow a warning, product label or veterinary instruction
  • administering a medicine or substance without appropriate veterinary direction
  • attempting an action in unsafe circumstances
  • an animal's underlying condition, unpredictable response or rapid deterioration
  • using an outdated copy, screenshot or reproduction of Website Content
  • relying on information from a third-party website
  • a device, network, browser, hosting or third-party service failure outside our reasonable control

To the maximum extent permitted by law, we exclude liability for indirect, incidental or consequential loss that was not reasonably foreseeable when you used the Website.

We do not exclude liability to the extent that loss is directly caused by our fraud, wilful misconduct, breach of a non-excludable statutory guarantee or other liability that cannot lawfully be excluded.

Nothing in these terms makes you responsible for loss caused by us or excuses us from taking reasonable care where the law requires us to do so.

14. Website availability and security

We aim to keep the Website available and secure, but we do not guarantee uninterrupted or error-free access.

We may suspend or restrict the Website to:

  • perform maintenance
  • address a security issue
  • correct information
  • comply with law
  • protect users, animals or our systems
  • discontinue a feature

You are responsible for maintaining reasonable security on your own device, browser and network.

15. Privacy

Our Privacy Policy explains how we handle personal information and limited technical information associated with the Website and App.

The Privacy Policy forms part of the information available to you but does not reduce any right you have under privacy law.

16. Changes to these terms

We may update these terms when the Website, App, law or our practices change.

The current version and effective date will be published on this page.

Changes apply from the stated effective date. They do not retrospectively remove rights or remedies that arose before the change.

Where a change materially affects users, we will take reasonable steps to make the change clear.

17. Severability

If a provision of these terms is invalid or unenforceable, it is to be read down to the minimum extent necessary. If it cannot be read down, it is severed.

The remaining provisions continue to apply.

18. Governing law

These terms are governed by the laws of Victoria, Australia.

You and we submit to the non-exclusive jurisdiction of the courts of Victoria and courts entitled to hear appeals from them.

This clause does not prevent you from relying on a right to bring a claim in another jurisdiction where that right cannot lawfully be excluded.
